Kabuga not be notified of appeal

Wife of Rwandan fugitive Felicien Kabuga will not have to notify him and Kenya Trust Company of an appeal over a property case.

Mrs Josephine Mukazitoni was yesterday "allowed to dispense with the service of notice of appeal upon Kabuga and the company."

She intends to appeal against a ruling on whether Kenyan courts can hear the property case. Mukazitoni is contesting a decision dismissing her application challenging the High Court’s jurisdiction to handle a suit on their property, the Spanish Villas.

High Court Judge, Justice Muga Apondi threw out her preliminary objection and ordered for the hearing of the case.
