A sex pest who preyed on his 10-year-old daughter was sentenced to life imprisonment by a Gucha court.
Siko Anyona, 40, admitted committing the offence before Ogembo Senior Resident Magistrate Lily Nafula.
He committed the offence at Eburi sub location, Gucha South District on June 6.
The prosecution told the court that at around 10 pm, the complainant was sleeping in their house when her mother heard screams from the room.
The mother walked out armed with a torch to find out why her child was screaming. She found the accused defiling her on his bed.
The accused tried to escape forcing the mother to raise the alarm. Neighbours came and arrested the accused before he was escorted to Etago Police Station.
The girl was rushed to Etago health centre where she was treated and a P3 form filled out.
In mitigation, the accused prayed for leniency vowing not to repeat the act.
Nafula ruled that the offence was serious adding it called for a deterrent sentence.
"Cradle snatchers like the accused do not belong in society. They must be kept away from many young, helpless girls out there," she ruled.
Orphan jailed for stealing
A man who took a customer’s Sh1,000 at a hotel pretending he would bring her change before disappearing with it has been jailed by a Gucha court.
Stima Zephania Moracha pretended to be the hotel’s cashier, took the money from the woman and lied he was going to look for change outside the eatery before he vanished.
In mitigation, Moracha said he was tempted to run with the money in order to feed a child his wife had left with him.
Probation officer Mr Patrick Amukowa told the court that the accused was an orphan and a single parent.
Esther Bosibori Nyakundi went to the hotel in Nyacheki market and took food worth Sh20. She then went to the counter, found the accused and gave him Sh1,000.
He was spotted two days later in the same market and arrested by wananchi who escorted him to Nyangusu Police Station. The money was not recovered.
Ogembo Senior Resident Magistrate Lily Nafula sentenced the man to six months community service for the offence he committed on May 17, at Nyacheki market, Gucha District.
Pastor charged with defiling minor
A pastor has been arraigned in a Bomet court charged with defiling a 10-year-old girl.
Joseph Kipkoech Tangus of the African Gospel Church (AGC) also faced an alternative charge of indecently assaulting the minor.
Tangus is alleged to have defiled the minor, on May 28th at Mobiriri village, Bomet District.
The pastor, a former employee of a local hospital, denied the charge when he appeared before Senior Resident Magistrate Mr Timothy Okello.
Okello ordered that the suspect, who was unrepresented, be released on a Sh50,000 cash bail or a bond of Sh200,000 with a surety of a similar amount.
The pastor was, however, unable to raise the money and was remanded in prison. The case will be mentioned on Thursday. The hearing was set for September 1.
Wife beater jailed for stealing brother’s ram
A habitual thief and wife beater who broke into his brother’s sheep pen and stole a ram has been jailed for three years.
Naiguta admitted that on May 18, this year at Ololchani location, Trans Mara District he stole the ram.
The animal belonged to Stephen Naiguta, a brother to the accused person.
Kilgoris Senior Resident Magistrate Roselyne Oganyo convicted Joseph Naiguta after he pleaded guilty to the charges.
The prosecutor inspector David Kirui told the court that while the complainant was asleep at 9pm, his herdsman went and told him that there was a person at the sheep’s pen. When he woke up, he found that one ram was missing.
The prosecutor said that the herdsman told the complainant that the accused had vowed he would take one sheep to treat injuries he sustained after the complainant’s donkey injured him. After reporting the incident at Kilgoris Police Station, a search begun where some mutton was found in a rack at the accused house.
On admission that he had slaughtered the ram, the accused was arrested and taken to a police station with the stinking meat.
A report by the District Probation Officer, Kennedy Achungo described the offender as a habitual thief and wife beater who had threatened to kill his family members on several occasions.
"Before he was arrested, his wife reported that she was paying the accused between Sh50 and Sh100 in order for her to sleep in their matrimonial house," read the report in part.
In mitigation, the accused sought for court leniency saying his children were very hungry and had no food.
"The complainant is my brother and so I decided to take his sheep. I was then arrested without knowing. I didn’t wish to commit such an offence but only for the sake of my children on that day. I will not repeat," he pleaded.
Car washer fined for clobbering colleague
A car washer found himself on the wrong side of the law after he differed with his colleague over their business.
Buna Zacharia found his colleague washing other vehicles and confronted him demanding to know why he was cleaning all the vehicles in the carwash. He then hit him with a club.
He was arrested and charged in a Mombasa court with unlawfully assaulting Peter Ndolo.
Mombasa Senior Resident Magistrate Teresia Mwangi ordered the accused to pay a Sh30,000 fine.
In default, the accused will serve a jail term of six months for the offence that he committed on May 31, along Moi Avenue, Mombasa.
In the same court, two women denied a charge of assaulting another woman.
Farhia Habib and Fatuma Hussein were released on a Sh20,000 bond until August 6, when the case will be heard.
